A legal challenge to Governor Walz’s designation of essential and critical businesses won’t be heard for a while. Dan McGrath is a spokesperson for the Free Minnesota Small Business Coalition.

“The Governor has 30 days to respond to our brief because the courts allow both parties equal time to file their response briefs,” said McGrath.

McGrath was asked if the Governor lifts restrictions and allows more small businesses to open, will the lawsuit be dropped.

“It would be valuable if the courts heard the case,” said McGrath. “So if in the future an emergency comes along we wouldn’t need to needlessly hurt the small businesses of Minnesota.”

The legal challenge was filed in the Minnesota Court of Appeals. McGrath says procedurally, that’s where challenges to rulings by the executive branch are filed
