The Lakefield City Council voted earlier this week to not use any resources to enforce Governor Walz’s stay-at-home. Blue Earth County Attorney Pat McDermott says the action brings up some interesting constitutional questions.

“Counties get their power from the state statute,” said McDermott. “The state’s 87 counties are basically arms of the state. Cities, on the other hand, receive their power from their town charter. And many cities say if it’s not in our charter that must mean we can do it. It often comes down to how are they going to enforce things.”

McDermott says decisions like these often pit law enforcement against elected officials because law enforcement is sworn to uphold the law.
