A 22-year-old Willmar man is facing preliminary charges of felony assault and interfering with a 9-1-1 call after Mankato Police say his dog attacked a maintenance worker at an apartment complex and, in turn, Diego Martiarena started punching the victim.

The maintenance man told investigators that Martiarena’s dog bit him in the left leg and when he tried to push or swat the dog away from him the owner started punching him in the face.

During the assault, the criminal complaint shows the animal continued to bite the victim. When he attempted to call 911, the man says Martiarena took his phone and threw it.

Documents show the victim’s nose was broken during the assault.
