A Mankato man is behind bars in Blue Earth County after allegedly assaulting an Officer after Tri-City Police responded to a domestic incident in Vernon Center.

Authorities say that 911 was called on Sunday afternoon after 28-year old Matthew James Smisek began to get into a heated argument with his girlfriend. The victim stated that a witness might have overacted. Police reportedly told the victim to call 911 again if he became concerned, as a 3-year old was present in the home and the victim was pregnant. 

Several hours later, Authorities were called back to the residence for another argument at which time Smisek allegedly threatened the victim. The man reportedly denied grabbing or pushing the woman.

According to the complaint, Smisek kicked the Officer in the face and continued to pull away from the Officer as she attempted to take the man into custody. He was eventually apprehended after the Police Officer threatened to use a taser.

Doctors evaluated the Officer and determined she had a concussion along and contusions on her chest and jaw.

Smisek faces six charges in total, including Felony 3rd Degree Assault, Felony 4th Degree Assault of a Peace Officer and Misdemeanor Fleeing from Police.

Court documents show Smisek was convicted of 2nd Degree Assault in 2013.
